We kindly inform you that effective as of the 15th of December 2018 changes will be made to:

  • Rules of bank accounts for corporate market customers in PKO Bank Polski SA,
  • Rules for issuance and use of business debit card,
  • Rules for issuance and use of business debit card to a currency account,
  • Rules for issuance and use of business charge card,
  • Rules for issuance and use of business credit card,
  • Tariff of bank commissions and fees at PKO Bank Polski SA for corporate customers.

All the regulations cited above change, among others, as a result of an amendment to the Act on Payment Services (PSD2), hereinafter referred to as the Act.
We invite you to read the details below.

The most important changes introduced in the Rules of bank accounts:

  • reducing the time of complaints processing in relation to rights and obligations under the Act,
  • changing the principles for covering costs of foreign transfer to the countries of the European Economic Area - the possibility of using only the SHA cost instruction, i.e. the cost sharing option between the sender and the recipient of the transfer, thereby the OUR and BEN cost instructions are withdrawn,
  • introducing the provisions now contained in the Rules for issuance and use of business debit card and the Rules for issuance and use of business debit card to a currency account,
  • changing the principles for settling transactions made with a debit card in foreign currencies (necessity of adjustment to the Visa Europe regulations regarding the change of the settlement currency from EUR to PLN).

In addition, we inform you that in the case of separate agreement / agreements on the issuance and use of debit cards - the issuance, use and settlement of transactions made with the use of these cards is carried out on the terms of these agreements. In the absence of such agreements, if you apply for a debit card, the rules contained in the account agreement and its rules shall apply, subject to prior annexing the agreement.

The most important change introduced in the Rules for issuance and use of a business charge/ credit card is the change in the principle of settling transactions in foreign currencies made with the card (necessity of adjustment to the Visa Europe regulations regarding the change of the settlement currency from EUR to PLN).
In addition, in the case of a credit card, the transaction settlement rules and the method of calculating interest on cash transactions were changed (from the day the transaction was registered instead of from the day the transaction was made).

As a result of the amendment to the Act, we have also adjusted the Tariff of bank commissions and fees at PKO Bank Polski SA for corporate customers by introducing the concept of a supplier providing the Payment Initiation Service.

Other key changes introduced in the Tariff:

  • withdrawal of PKO Diners Club debit cards from the Bank’s offer,
  • unification of commission for activities related to granting, administrating and modifying the terms of the loan agreement,
  • change in the method of collection and the amount of commission for currency conversion of operations for cards with the VISA acceptance mark.

We encourage you to review these documents.

In addition, we wish to inform you that, pursuant to the applicable regulations/ rules, the Account Holder may terminate the following agreements if they do not accept the changes:

  • current/auxiliary account agreement within 14 calendar days as of the notification receipt date, subject to a 30-day notice period,
  • an agreement on the issuance and use of debit/credit cards within one month as of the notification receipt date (if they have not agreed with the Bank a shorter period, but not shorter than 7 days, counted from the date of delivery of the notice),
  • an agreement on the issuance and use of charge cards within one month as of the notification receipt date.

The changes shall be deemed accepted unless the agreements are terminated within the above deadlines.
